{"id":14125,"date":"2014-12-13T15:52:54","date_gmt":"2014-12-13T15:52:54","guid":{"rendered":"http:\/\/independentweekender.com\/?p=14125"},"modified":"2014-12-13T15:52:54","modified_gmt":"2014-12-13T15:52:54","slug":"man-waives-hearing-in-fatal-crash","status":"publish","type":"post","link":"https:\/\/www.greenstreetdata.com\/PS\/2014\/12\/13\/man-waives-hearing-in-fatal-crash\/","title":{"rendered":"Man waives hearing in fatal crash"},"content":{"rendered":"<p style=\"text-align: center;\"><strong>BY STACI WILSON<\/strong><\/p>\n<p>The case against the driver in an Aug. 29 fatal all-terrain vehicle crash will head to the Susquehanna County Court of Common Pleas.<\/p>\n<p>Cody Mosher, 24, of Laceyville, waived his Monday, Dec. 8 preliminary hearing in front of Magisterial District Judge Jeffrey Hollister in Montrose District Court.<\/p>\n<p>Mosher was driving a Polaris Ranger on Place Road, Auburn Twp. in the rollover crash that killed Jeremy Mowry, 38, Meshoppen. Mosher\u2019s ear was severed and a finger was severed in the crash.<\/p>\n<p>Two other passengers were also injured in the crash, Alexander Mowry, of Meshoppen; and an unidentified 12-year-old male, also of Meshoppen.<\/p>\n<p>Mosher faces a felony charge of homicide by motor vehicle while driving under the influence; and three felony counts of aggravated assault by motor vehicle while DUI.<\/p>\n<p>Other charges lodged against him include a misdemeanor count of involuntary manslaughter; DUI; and three counts of recklessly endangering another person.<\/p>\n<p>According to the affidavit, Alexander Mowry told police he arrived at Jeremy Mowry\u2019s home in the evening with his 12-year-old son. Police said Mowry reported that Mosher was already at the home and had been drinking beer.<\/p>\n<p>The three men and one child went to spotlight deer in a Polaris Ranger, with Mosher driving. According to police, the ATV reached about 20 miles per hour.<\/p>\n<p>According to the affidavit, Alexander Mowry said Jeremy told Mosher to slow down; when the brakes were applied the vehicle went into a ditch and rolled over.<\/p>\n<p>Jeremy Mowry was pronounced dead at Tyler Memorial Hospital later that night.<\/p>\n<p>Mosher was taken to Geisinger Medical Center for treatment of his injuries.<\/p>\n<p>Police found several beer cans and a bottle of brandy at the scene. During the investigation, ambulance crew members on the scene reported that they could smell alcohol on Mosher. A test revealed his blood alcohol level was .14 percent.<\/p>\n<p>Mosher remains free on $25,000 unsecured bail.
