A 24-year-old Laceyville man admitted he was driving the ATV on the night his friend, a passenger in the vehicle, was killed.
Cody Mosher pleaded guilty Friday to aggravated assault by motor vehicle while DUI; involuntary manslaughter and DUI in connection with a Aug. 29 crash in Auburn Twp. that claimed the life of Jeremy Mowry, 38, of Meshoppen.
Mosher was driving the 2010 Polaris Ranger when is struck a stone wall, overturned and came to rest on its wheels, District Attorney Jason Legg told the court.
Mosher’s attorney George Lepley noted that his client is admitting to the facts in the case but has no recollection of the accident.
As part of a plea agreement, Mosher will serve consecutive two, 2-1/2- to year sentences in the county jail, and be eligible for work release.
Legg said Mosher also agreed to meet with the victim’s family in an impact meeting. “They’re friends,” Legg said. “It’s been a difficult time for all.”
Mosher was scheduled to be sentenced on March 19. However, Lepley said his client was scheduled to undergo surgery to reconstruct his hand this month and would require physical therapy following that.
President Judge Kenneth Seamans advised the attorney to apply for a continuation of the sentencing.
